Day Two ERT: Fairfield vs MOE. My favorite quotes from today’s hearing.

One thing we can all agree with is that this project was not handled the way we all would like.

Vic Schroter (Director MOE)
Explained that  his responsibility was  to look at the amended REA.
Asked about the lack of property line assessment with the first REA, he stated: They should have submitted the property line assessment.
Asked “Does anyone do site visits and how do you confirm accuracy?”  His simple answer was We TRUST the proponent to give correct information.

Asked why the MOE did not realize that the post construction study raptures was not included  in the approval.He said that in the original approval it was left out by mistake so it was included in the second (amended) approval.  (of course they neglected to mention to us that it had been overlooked, and that  they were making a correction – probably another “mistake”)

Ann Meinen:
My faith in MOE and Government has been destroyed when they do not have to follow regulations, or care abut my safety and my well being.  Regulations should apply to all, and no exceptions for big corporations.
Since the MOE did not inspect or monitor the construction of the turbines but this  amendment was allowed it seems the  MOE has a policy of “forgiveness” rather than “permission”.

The proponent should be charged with an offense for contravention of the regulations and the HAF Wind Project turbines should be removed.

Eric Stoll asked Ann about the harm to raptors that she had referred to and she said that she had found a  dead raptor on road  which had probably catapulted there from a collision with turbine blades.  He said that if you found a raptor on the road, it did not necessarily get there from the turbine.  Ann said “I have NEVER seen a raptor killed by a car”.   (The poor raptor is probably still in Anns freezer waiting a final verdict on its demise- which, when it comes will in all probability be that Ann was right, Stoll was wrong)

Day One ERT: Fairfield vs MOE.

After the reminder by the Vice Chair of the Tribunal, Heather Gibbs, that the Tribunal is able only to confirm, alter or revoke the approval and that it is the responsibility of the Appellant  to prove only serious harm to human health or irreversible harm to the environment, the ERT got under way.
B821406432Z.1_20131006220008_000_GOB1386DL.3_ContentDeb Murphy gave a very impressive opening statement, where she challenged the tribunal to what is right,  to reconsider the word “only”.   She said that if the tribunal rules only on the “serious harm” and “irreversible harm” then they are saying that regulations and rules do not exist.
Loretta Shields, the first presenter, gave a passionate presentation.  The Lawyers for the MOE and HAF tried time and time again  to trip her up, but she never wavered..  She had all her facts: knew them better than her opponents did.  She reminded them often that she was not an expert but even more often, she had to remind them that the studies had not been done, so rules were broken
Slota Zoretic was priceless as a witness. No one else would get away with the discussions that she brought up simply by her beautiful Croatian/Canadian accent . She did not hesitate to remind Mr. Stoll that she makes mistakes sometimes too, as we all do, but for him to say that the turbines placement was a “mistake” was stretching things.
The hearing resumes tomorrow morning at 10am at the Township office in West Lincoln.

Time to have your well water tested prior to wind plant construction.

 It is best to have your well water tested “before” any construction starts if you are any where near where a turbine is to be erected.  With potential blasting, digging etc. comes a potential that your well water will be affected.  When it comes to dealing with wind projects it is imperative that the public documents everything.  Without documentation there will be NO hope of proving that the project was/or could of been a contributing factor to the change in your well water.  WE must use the “precautionary principle” even if our Government and Wind Companies choose not to.

If you have lived for years at your current address and rely on your well then it is highly recommended that you get the testing done in the unfortunate instance that near by construction does have an effect, either disrupts the flow to your well or the water becomes un drinkable, other wise it will be difficult to prove that the construction its self may have been a contributing factor.

If EVERYONE gets their water tested PRIOR to wind plant construction and issues arise, all of those in an area could join forces, with documentation in hand making  it difficult for the courts to not take you seriously.

Remember to also get a COMPLETE Physical, blood tests, blood pressure, hearing….everything checked BEFORE the turbines start turning.  As with the Water Well testing these documents may be of great value later in the courts if needed.

download (4)Around the world markets for renewables industries are directly linked to the flow of money from policies endorsed by governments leading to the enrichment for the proponents of the projects.

In Australia wind developers are currently fighting back in a life and death battle against the threat of the RET being revoked. This is signaling the death knell for the renewable industry in the land down under.

Australian report urges end to renewable energy target

While in the United States project financiers and project builders are breathing easier with the released notice announcing the security of continued qualification for the tax credits, PTC or ITC, if the projects have met the following tests:  wind or renewable energy project had  been started. or paid 5% of the costs by January 1 2014.  The threshold to meet these tests were clarified and the one for the physical work test reads as;

“The Notice clarifies that there is no minimum amount of work or monetary threshold required to satisfy the Physical Work Test

United States: Notice 2014-46 Provides Additional Guidance On Eligibility Of Wind And Other Renewable Energy Facilities For The PTC Or The ITC

Meanwhile the doors remain wide open and  things are swishing , swooshing and sizzling  along for wind and other renewable projects In Ontario.  The FIT 3 line up of approved projects has been made and this round  was mainly comprised of solar installations:

FIT 3  hasn’t changed the appetite for  some in doing business in Ontario such as  Next Era ( parent company Florida Power and Light)  They remain keen to continue to take advantage of Ontario and announced they were looking for even more projects to sustain them…..

Renewable energy projects grow vigorously with the guarantee of subsidies and Ontario continues to follow the path of sustaining the industry at all costs.

Australian Wind Industry Doomed: Tony Abbott Signals the End of the Mandatory RET

Britian,  Germany, US and Australia all re-thinking the renewable / turbine/ solar thing….meanwhile in Ontario it’s full steam ahead?

STT followers have been delighted with news that Tony Abbott, Joe Hockey and Mathias Cormann have teamed up to axe the mandatory RET (see our post here).

In response to the PM’s mooted plan, the wind industry and its parasites have been reduced to making idle threats of “revenge” and bleating about “sovereign risk”. Despite a rear-guard effort by Environment Minister, Greg Hunt to salvage something of the mandatory RET, his boss has confirmed that his mission is to kill it outright. And that pretty much means the end of the wind industry as we’ve known and grown to despise it. Here’s the Australian Financial Review on the beginning of the end.

Brazil Tax Exemption Removal Curbs Wobben’s Wind Turbine Orders

Enercon GmbH’s Wobben Windpower is losing contracts in Brazil after tax authorities canceled some exemptions for wind turbine manufacturers in the country, an official said.

The Brazil unit of Germany’s Enercon had a single customer so far this year, Mathias Moser, a vice president of Wobben, said in an interview yesterday in Rio de Janeiro. The company had considered leaving South America’s fastest-growing market after Brazilian tax authorities in April removed a tax incentive and required turbine makers such as Wobben, Spain’s Gamesa Corp., Tecnologica SA and Denmark’s Vestas Wind Systems A/S to pay back taxes for the exemption.

“This is definitely a restructuring year for us in Brazil,” said Mathias, who came to the country in April amid a management change.

Enercon, based in Aurich, Germany, decided to stay in Brazil last month after filing an appeal on the tax incentive ruling, according to Mathias. He didn’t disclose how much the company owes in back taxes. Brazil is seeking the previous five fiscal years of back taxes for the exemption.

“We have always produced in Brazil, so we have had the benefit for many years,” Mathias said. “It is a lot of money.”

Residents File Class-Action Lawsuit to Block Wind Turbines Near Kingfisher

Another Class-Action Lawsuit.

We made the wind developers rich putting them up and now the lawyers are going to get rich helping take them down.

Seven landowners filed a class action lawsuit this week to prevent wind turbines from being built near their homes in Canadian and Kingfisher counties.

In the complaint, which is embedded above, the landowners claim that planned wind farm projects controlled by Virginia-based Apex Clean Energy would create a nuisance, devalue their property and adversely affect their health.

An organization that opposes wind projects in the two counties, the Oklahoma Wind Action Association, brought the lawsuit on behalf of the landowners. The suit was filed Aug. 27 in the U.S. District Court for the Western District of Oklahoma.

The landowners who brought the lawsuit all live within three miles of the planned wind farm, and, in many cases, own property within the “no-build” zone of the planned locations of the 500-foot-tall turbines.

Will heat be the winner in de-icing turbine blades?

Interesting that the wind industry is concerned about ice falling on people and cattle but the MOE is not aware of any concerns.

The wind industry is trying to find improved methods of prevention of ice, and the MOE is satisfied with the present system.

When it comes to keeping wind turbines operating smoothly in icy conditions, there are several approaches being considered and tried, from the highly technical to the old school ‘shiver’ technique.By Susan Kraemer Some of the best wind resources in the world are in some of the coldest regions. These regions, with the best potential for wind energy because of their sparse population and favourable wind conditions, are expected to host 72 per cent of new wind farms through 2017, according to Finland’s State Technical Research Center Valtion Teknillinen Tutkimuskeskus (VTT).

But howling winds and temperatures as cold as -35 C can place enormous demands on wind turbine systems – and on the incomes of wind farm operators, because ice build-up on blades can reduce electricity generation by as much as 20 per cent.
