Request for Support for Stay Proceeding- London on Sep 22 & 23

supremecourt_gavelThe SWEAR/HEAT Stay Court Proceeding with Julian Falconer and team has been scheduled for Monday, September 22nd and Tuesday, September 23rd in London. The proceeding starts at 10:00 a.m. on Monday morning. We are hoping that lots of people will come out and show their support by peacefully protesting outside the courthouse and respectfully attending inside the court room. Blown over: Residents rejoice as wind turbine battle comes to a conclusion

ALLEGANY, N.Y. — Close to eight years of legal battles, community upsets and neighbors bickering with neighbors over a proposed 29-wind-turbine farm project in the town of Allegany came to an end on Tuesday.

The final nail in the coffin of the proposed EverPower Wind LLC farm in the communities of Chipmonk and Knapp Creek was hammered when the Allegany Town Board unanimously voted to rescind the wind overlay district.

“It’s been a long time coming and I’m glad this is over,” said Chipmonk resident Karen Mosman after the meeting. “But I’m in shock, is it real?”  Read rest of the article here.

One thing we can all agree with is that this project was not handled the way we all would like.

Vic Schroter (Director MOE)
Explained that  his responsibility was  to look at the amended REA.
Asked about the lack of property line assessment with the first REA, he stated: They should have submitted the property line assessment.
Asked “Does anyone do site visits and how do you confirm accuracy?”  His simple answer was We TRUST the proponent to give correct information.

Asked why the MOE did not realize that the post construction study raptures was not included  in the approval.He said that in the original approval it was left out by mistake so it was included in the second (amended) approval.  (of course they neglected to mention to us that it had been overlooked, and that  they were making a correction – probably another “mistake”)

Ann Meinen:
My faith in MOE and Government has been destroyed when they do not have to follow regulations, or care abut my safety and my well being.  Regulations should apply to all, and no exceptions for big corporations.
Since the MOE did not inspect or monitor the construction of the turbines but this  amendment was allowed it seems the  MOE has a policy of “forgiveness” rather than “permission”.

The proponent should be charged with an offense for contravention of the regulations and the HAF Wind Project turbines should be removed.

Eric Stoll asked Ann about the harm to raptors that she had referred to and she said that she had found a  dead raptor on road  which had probably catapulted there from a collision with turbine blades.  He said that if you found a raptor on the road, it did not necessarily get there from the turbine.  Ann said “I have NEVER seen a raptor killed by a car”.   (The poor raptor is probably still in Anns freezer waiting a final verdict on its demise- which, when it comes will in all probability be that Ann was right, Stoll was wrong)

Day One ERT: Fairfield vs MOE.

After the reminder by the Vice Chair of the Tribunal, Heather Gibbs, that the Tribunal is able only to confirm, alter or revoke the approval and that it is the responsibility of the Appellant  to prove only serious harm to human health or irreversible harm to the environment, the ERT got under way.
B821406432Z.1_20131006220008_000_GOB1386DL.3_ContentDeb Murphy gave a very impressive opening statement, where she challenged the tribunal to what is right,  to reconsider the word “only”.   She said that if the tribunal rules only on the “serious harm” and “irreversible harm” then they are saying that regulations and rules do not exist.
Loretta Shields, the first presenter, gave a passionate presentation.  The Lawyers for the MOE and HAF tried time and time again  to trip her up, but she never wavered..  She had all her facts: knew them better than her opponents did.  She reminded them often that she was not an expert but even more often, she had to remind them that the studies had not been done, so rules were broken
Slota Zoretic was priceless as a witness. No one else would get away with the discussions that she brought up simply by her beautiful Croatian/Canadian accent . She did not hesitate to remind Mr. Stoll that she makes mistakes sometimes too, as we all do, but for him to say that the turbines placement was a “mistake” was stretching things.
The hearing resumes tomorrow morning at 10am at the Township office in West Lincoln.

Yard Sale Ready for Tomorrow and A visit by a Very Special Lady.

While the Mothers (and the guys) were busy setting up for Tomorrows Yard Sale we were visited by a very special woman whom most have heard about or have heard speak.

10430920_607447802709849_2650086089010286948_nStephana Johnston has lived beside a wind farm near Lake Erie since 2010.  She dropped by the Mothers Against Wind Turbines Inc.  to show her support by dropping off a van FULL of items for our Yard Sale, Sept 6.

And she bought some Raffle tickets as well!!  Good Luck, Stephana!!

10653802_607447819376514_8029953276855539632_nWe spoke with her and sadly she told how her health continues to slowly get worse.  How she is having difficulty keeping her sugars at good levels,  because her stress level is so high all the time having to live in her house.

She did however comment on how good she was feeling while chatting to us, mainly because it had been a bit more than 2 hours since she had left her house to come visit us.

This is an 85 year old who instead of enjoying her retirement travels to other communities to speak to rooms full of people about how the turbines have stolen her peace, her health, her home.

She tells residents that from inside her home, the neighbouring wind turbines sound like a Boeing 747 jumbo jet flying overhead

“It never goes away,” she said. “I can’t sleep with that going on.”

…AND then she travels two hours to contribute to  West Lincoln’s Fight against the NRWC project because she thinks it’s worth fighting for and doesn’t want what happened, is happening, to her to happen to you or your family!!

This is why setback distances are so important but really why are these monsters still being built?

Below is a frightening comment to a story in the Batavia, NY newspaper-It was sent by Mary Kay Barton of Wyoming County which is where Orangeville is located. Wyoming County is located just east of Buffalo, NY. Wildlife and wildlife habitat gone with the wind.

READ the SAD TESTIMONY (below) of another couple now stuck living within Invenergy’s Orangeville, NY wind factory, who unfortunately, did not heed our warnings and get involved in fighting the wind mess prior to the wind factory being built. Can they expect ANY HELP from our elected “Public Servants”? Can they expect any coverage of their problems by the local newspapers & media? Time will tell, but it’s not hard to figure out why the world is in the sad state of affairs that it is in, when people in our own small towns are willing to throw their neighbors under the bus for a few bucks while those who were elected to ‘serve & protect’ them continue to ignore the situation – all in pursuit of a complete FRAUD.

I would like to chime in here, being located in Orangeville myself.we never took a side

Where we live, we are surrounded by more than 6 turbines with in 1/4 to

1/2 mile I’d guess. it may be more turbines than that im just going by
how i can see easily.  We moved to orangeville about 5 years ago and were
totally neutral to the whole wind turbine issue.  We figured lower
property taxes would be nice and that how bad can the turbines be?  So
the fight about turbines went on for years and we never took a side.

Then the turbines started being built. It was a mess and you dont absorb how big a turbine is until you see 1 blade being trucked in on a semi with a double length trailer bed. Months later after all the mess, they were done and running. First thing you notice is no more clean night sky, now there is always blinking red lights and if its foggy, the whole sky blinks red.

Then we noticed water vibrating in our barn and in our house. Now we have lived here 5 years and never seen that before. And it happens In Just a plain old water bottle, the water vibrates… like in the movie jurrasic park when the t-rex is coming…its just like that just not as severe.

Then as the weather changed for the worse or if the wind was stronger, we noticed the water vibrations get worse and we also noticed the wind turbines make much more noise.In our house we actually get a type of thumping in the right conditions. Its pretty terrible. I will close windows, turn fans on, turn the a/c on, turn the tv on just to drown out the noises. It also gives me a “I need to get out of here” anxiety feeling…and well, there no getting out of anywhere…its where you live!  And we also run our business from here, so no escape at work!

On the bad nights it effects my sleep, I just cant fall asleep. I even
tried ear plugs…which will work sometimes.

Thats another thing, forget having your windows open for the most
part…especially at night, that seems to always be when the turbines
make the most noise. But they can have noisy days if the weather is
right.

The one time it was like 3 days of constant thumping and noise...we
called the invenergy rep to complain and they sent out some lady…didnt say much and didnt help much either.

We had another instance where she and some head guy from Chicago came…I showed him what the water was doing on a video i had on my phone that I took, and also showed him in person, but he didnt even really acknowledge it. All they care about is the DB meter which is really not a fair measurement of what is going on here. Overall we probably called invenergy 5 or so times to complain over the past 5 or so months. But after a few times it just seemed like the same song and dance and then there doesn’t seem to be a point in calling to complain anymore.

I will say now, i am getting headaches more frequently...not sure if
its related, but it has increased. And i feel like i never really get
good sleep...probably because the noise they make takes you out of REM sleep would be my guess.

But its the thumping and noise that i cant deal with. Forget open
windows, forget enjoying outside. Unless its just the right day with no wind or barely any and the turbine are barely even moving or are just not moving at all…you will hear them.

Looking back now, I would rather pay the higher taxes then have the wind turbines here. They really have changed life in a negative way and i dont think anyone deserves that.

To all that think Im making this stuff up, go live by some turbines…esp. these huge ones we have here in orangeville that are even bigger than the sheldon ones, for at least a month or two, and then tell me what you think.

I wish i would have know about this lawsuit as maybe it will help fix
something, the more people the better as there is strength in numbers, but how were we supposed to know about it to get on board?

BRITAIN FACES ‘WINTER OF BLACKOUTS’ AS FIRMS ARE ASKED TO RATION ELECTRICITY

Britain facing electricity rations this winter.

No wind for the turbines?   But diesel generators are being paid to be on standby.  Seriously you can’t make this stuff up.

“The chickens are coming home to roost”. So said the Ukip energy spokesman, commenting on the news that businesses are being asked to join a 1970s style energy rationing program this winter to stop Britain being plunged into darkness. Offices and factories will be offered compensation to shut down for four hours a day so that energy can instead be diverted to households.

Ofgem, the industry regulator, has welcomed the proposals but pointed out that “it would cost quite a bit”. It comes as the gap between energy consumption and production has narrowed to dangerous levels, leaving the system increasingly vulnerable to unexpected events.

“The Government has been crossing its fingers and hoping that it’s all fine. It’s blindingly obvious that if you have a tight market then you will be more vulnerable to shocks,” analyst Peter Atherton of Liberum Capital told the Daily Mail.

Fires at two coal stations, one in West Yorkshire, the other in Shropshire, have put those sites out of action, and a gas station in Essex has been unexpectedly closed since the summer. However, National Grid indicated that these setbacks have merely brought the deployment of this plan forward one year.

Be honest, would you go to the Manitoulin Island now??

Maintain the sacredness and sanctity of the Island

One of your greatest resources is eco-tourism, but those towering industrial-sized wind turbines are an unsightly welcome that are destroying the awesome experience of any visitor to the Island. More importantly, the turbine’s intrusive and horrific Gothic presence disregards a sacred obligation to protect one of the most beautiful bio-systems in the world. In addition, the Dark Sky Sanctuary that is an important global contribution is threatened by the towering night lights on the horizon.

Take the opportunity now to stop this intrusion that is defacing and devaluing the sanctuary of beautiful Manitoulin Island. Manitoulin could be a global leader if you can maintain the originality and sacredness of the Island that is a shining crystal for us all to behold. Like an invasive species, the influx of towers is turning visitors away and preventing them from enjoying the treasure they expect from an island gem, such as this.

Here is the official notice of the ERT to be held on Monday, Sept. 8 at West Lincoln Council Chambers.

If at all  possible,  attend these hearings, to  show our support for the dedicated people in West Lincoln who are NOT allowing the MOE and IPC to just do as they please in our township.   Lets demonstrate that West Lincoln is a force to be reckoned with.

Further to my email dated Wednesday, August 20, 2014 5:11 p.m.,  I wrote to advise, the Parties, Presenters and Participants that the Hearing has been scheduled to commence September 8, 2014 at the Township of West Lincoln Council Chambers located at 318 Canborough St., in Smithville, Ontario. Furthermore, hearing and venue information is available on the Tribunal’s website, which is http://www.ert.gov.on.ca/english/hearings/index.htm.

The Tribunal will be issuing further notice of the venue that will be copied to all those who have advised the Tribunal of their interest in the matter and will speak this change as well.
