Attn Ms Eva Pietrzyk                                                                           27th December 2014

My husband Leon & I are known as receptor 2297, we purchased our property 15 years ago & built our dream home, a modest 1,100 sq ft residence & a barn with an arena for our 29 horses, ponies & donkeys, most of whom are rescued or retired, ages ranging from 17 months to 38 years. We operate a pony ride business attending fairs, festivals & children’s birthday parties. We have 27 years experience in all aspects of horse husbandry, including training, farrier work, worming, medicating etc;  Our equines undergo regular yearly physicals from our vet which include vaccinations. Looking after & caring for our horses is our life, although 24\7 we love this lifestyle & could not imagine our life without our animals. The economic impact that the proposed W.T.s could have on our lives is frightening, our livelihood depends on our ponies and they depend on us to take good care of them. I fear that being surrounded by so many W. T.s, our well, which is our only water source, may be affected in some way, how would we water 29 horses ?????  Water makes up 62-68% of horses body weight and is essential for life, an average size horse will drink approx; 10 U.S. Gallons per day-multiply that by 29!!!! It is critically important for horses to have access to a fresh clean supply of water at all times. Moving our horses and ponies to another barn is out of the question, how could we possibly afford to board 29 horses and ponies at $400-$600per horse per month and what barn could accomodate an extra 29 boarders????

We are extremely concerned that N.R.W.C. Intend to erect 3MW  Enercon 101 industrial wind turbines so close to our property, the 2 closest WTs are T31=587 meters with a predicted 39.5 decibels & T32= 600 meters with a predicted 39 decibels, another 5 WTs will be located less than 2 kms = T33 T34  T76  T35  & T55 another 3 are less than 3 kms T02 T06 T01 making a total of 10 in close proximity & 24 less than 5 kms. The R.E.A states……a minimum setback of 550 meters for one to five wind turbines, with setbacks increasing with the number & the sound level rating of turbines http://fit.powerauthority.on.ca./program-resources/newsroom/september-24-2009-ontario-makes-it-easier-faster-grow-green-energy  On the 29th April 2013 Premier Kathleen Wynne signed a document which reads….The R.E.A.establishes one of the strongest setback requirements in North America;- a minimum setback of 550 meters with setbacks increasing with the number of turbines and their sound level rating. Some of the largest wind facilities will require 1.5 klms setback from the nearest residence….. Also at N.R.W.C.’s first presentation to the public they posted…….Note; If there are more than 5 turbines within 3km of a noise receptor or if any turbines have a sound power level greater than 102 dba, greater setback distances must be met and/ or noise studies must be completed. [I took a photo of this statement with my cell phone].

MAWT, Is our hero!!

Congratulations to MAWT IOnc, for appealing the NRWC approval. Although the ERT has NEVER been an effective way to stop a project, you followed the regulations in spite of it. Even though the EBR instructed you to place FOI requests to get info and documentation, and in the end, even in disclosure the info was not provided, and even though your witness statements were stuck down to only a few pages, and even though you were faced with the impossible task of proving “serious harm” you did not give up. You can be so proud of your efforts and we, your community are eternally grateful for what you did for us.

You are our hero’s.

N. M. Rozenburg

Medical Officer of Health breached public health safeguard, say Haldimand-Norfolk residents

This is what will happen if we don’t fight.   Some people WILL suffer.   It’s a roll of a dice as to who.  Are you willing to bet it won’t be you or a member of your family, a friend, a co-worker?  It WILL happen.  It HAS happened here with the 5 HAF turbines.   It will happen….it always does.

Ever since the turbines starting spinning in the Haldimand-Norfolk communities of Cultus-Clear Creek-Frogmore, people have experienced adverse health effects from the noise and infrasound/sound pressure produced by the turbines. Some people live with as many as a dozen or more turbines within a few kilometers.

Turbines near Port Rowan: residents allege Medical Officer of Health has breached public health responsibilities

In 2009, more than 70 residents signed a petition, with the claims that they had personally been affected by the turbines erected by AIM PowerGen (CEO Mike Crawley, later CEO of GDF Suez, and president of both the Ontario Liberal Party and the Liberal Party of Canada).

In 2014, residents asked the local Medical Officer of Health Dr Malcolm Lock, whether he had investigated the possibility of a health hazard as he is mandated to do under the Health Protection and Promotion Act.

In a letter delivered to a resident by post, Dr Lock claims to have”investigated” and found “no significant environmental issues.” He referred to correspondence from the Ontario Ministry of the Environment, and to the report from the Chief Medical Officer of Health for Ontario, which was published in 2010 but prepared in 2009, five years ago.

The report from the Chief Medical Officer of Health looked only at direct pathways for the cause of adverse health effects and did not investigate indirect paths. It also noted that there was a gap in information and recommended that further research be done.

Residents are claiming a “breach” in how public health is safeguarded by their local public health officials. See the full report here: 2015-01-28 Haldimand Norfolk public health update

Even if the ERT Doesn’t Pay Attention to Mike Jankowski’s Warning. You will…

This is the “condensed” version of Mike’s presentation.  We will be posting the not so “condensed” version soon.  But be forewarned.  You won’t like what you hear and you won’t be happy if the ERT decides to not take Mike’s warning seriously because NIMBY should really be NIABY….Not In Anybody’s Back Yard!!
I attach photo of some of my document submissions and Anne Fairfield and I assembling it.   (Note: I did not require this amount of paper, the MOE did)
My main points are;

Words of Thanks to MAWT, very much appreciated! Thank You

Can’t say enough about how impressed I am with the way MAWT have brought their appeal case together and are presenting it.   And that’s only after two very brief appearances to show support, at the Preliminary Hearing and today.

I will be there again, but quite honestly, being just an observer, and not a part of the Hearing,  I cannot see or hear the ERT Chair and his cohorts or any of the assembled lawyers for the proponents open their mouths without having a great urge to throw something at them! Niagara Region Wind farm appeal: evidence shows damage to at-risk species and protected areas

by Wind Concerns Ontario, Jan 27 2015

Loretta Shields, a member of Mothers Against Wind Turbines, presented at the appeal of the approval of the Niagara Region Wind Corporation wind power generation project yesterday, and outlined the many negative impacts on species at-risk, and environments such as woodlands that are supposed to be protected under Ontario legislation.

“There are so many issues,” Shields tells Wind Concerns Ontario. “For example, there is no evidence to show that winter raptor transects were conducted within the interior of the woodlands.  Sixty-two permits are required by the Niagara Peninsula Conservation Authority.  These are still pending.   There are 20 industrial wind turbines proposed in Blanding’s turtle habitat in Lowbanks, all on private property.  There are many properties within this habitat where ‘alternative investigations’ i.e., ‘roadside surveys’ were allowed.  The MNR is allowing this to proceed.”

Shields had prepared a 32-slide PowerPoint presentation for the Environmental Review Tribunal, detailing sections of Ontario legislation that ought to be applied to protect the environment and wildlife, but are being overlooked or ignored in order to allow the power development to proceed.

Shields also told WCO she was grateful to learn about the “many birds and raptors” in the project area during her investigations and audit of the wind power developer’s application documents: “a silver lining” to this event, she said.

Details on the hearing dates may be found here.

Shields’ PowerPoint presentation may be found here: Powerpoint for NRWC Appeal Jan 26

More details on what happened at the hearing may be found in this excellent report from Mothers Against Wind Turbines here with information on how to donate to this legal action .

Thank You to Wind Concerns Ontario for the show of support!
