Report on the Preliminary ERT Hearing of Platinum Produce vs South Kent Wind

The second appeal of the South Kent Wind project began with a preliminary hearing in Blenheim yesterday (Sept 5). Robert Wright was the only tribunal judge presiding. Two lawyers (Bunting and Powell) were there to represent South Kent Wind, and at least 3 lawyers (Jacobs, Horner and ?) were there for the MOE as well as a representative or two for the minister of the Environment. The appellant, Platinum Produce, was represented by Graham Andrews (from the Gillespie firm).   No one requested any status to present material or raise issues at the hearing.

South Kent Wind began by seeking dismissal of the constitutional challenge raised by Platinum Produce as well as a complete dismissal of the hearing. This was echoed by the MOE who also said that the Tribunal was not the proper jurisdiction to raise constitutional issues.

Climate Commission’s latest report slammed as ‘environmental activism’

Tell us something we don’t already know. The Climate Commission has got nothing whatsoever to do with impartial, free-thinking scientific enquiry. It’s sole purpose is to regurgitate government climate policy, couched in pseudo-science and alarmism.

Monday’s “Critical Decade” report, which claimed that there is a one-in-two chance that there will be no humans left on the planet by 2100, has been rightly exposed as extremist environmental propaganda:

THE mining industry has lashed out at the latest Climate Commission report, labelling it taxpayer-funded environmental activism that would devastate the Queensland economy.

Minerals Council of Australia chief executive Mitch Hooke said the report, which called for an end to most coal mining, crossed the line from scientific analysis into environmental campaigning.

The report warns that unchecked climate change would hit hard at Queensland’s biggest industries: mining, cattle and potentially tourism, through impacts on the Great Barrier Reef and Wet Tropics.

It was a wonderful day yesterday at the SWEAR golf tournament fundraiser! Marcelle jokingly said it felt funny to be there with everyone without a protest sign and to be not yelling at some politician or wind rep! How true!

People were still talking about how articulate and smart Julian Falconer was on the ERT conference call on Friday, how he challenged things that had never been challenged before and how he got what he wanted to get, all the way through the call . He will do only one ERT as a formality to show how ineffective the ERT process is in order to move on to a courtroom where we need only to prove possibility of harm to humans from industrial wind turbines.

In March, 2013 the Canadian Auto Workers Union began operating a single wind turbine on its property at Port Elgin in the town of Saugeen Shores, ignoring the concerns of families living in homes nearby.

The CAW  wind turbine is much smaller than those installed elsewhere in Ontario (capacity of 500 KW vs 2 MW), but is not subject to a minimum setback distance due to its being operated at a noise level slightly below the threshhold specified by the GEA.  As a result, more than 100 homes are situated inside the normal 550 m minimum setback distance.

Five families living between 350 m and 2 km of the turbine made deputations to Saugeen Shores Council on August 26, 2013.  Their reports of medical symptoms and loss of enjoyment were so credible and compelling that Council voted to request that the CAW shut down the turbine.

The price of power for many Ontario households and businesses has spurted higher as the “global adjustment’ – an extra fee tacked onto the market price – has jumped to a record high.

The market price for electricity in Ontario Tuesday was about 2.5 cents a kilowatt hour. But the global adjustment for September will add another 8.72 cents to the market price for customers who aren’t covered by the province’s regulated price plan.

Those prices are just for the energy portion of the hydro bill; delivery and debt retirement charges are in addition to that.

Fears for children’s safety after turbine breaks up

FRESH fears have been raised about children’s safety after a wind turbine similar to ones installed at schools in the Highlands started to break up after being hit by a powerful gust.

Part of one of the structure’s blades was thrown about 60 yards as it disintegrated.

Worried parents believe pupils could be seriously injured or even killed if the Caithness incident was repeated at one of the 13 primaries and secondaries across the region which have their own turbines.

MILLBROOK — Met by an angry crowd and a team of disapproving Cavan Monaghan Township councillors, the developer of a proposed wind farm was sent a clear message on Tuesday (Sept. 3).

In town to make a delegation to the Township regarding a five-turbine wind farm that would overlook the Devil’s Elbow skill hill area and a new subdivision, developer Martin Ince needed a police escort to help him get past nearly 200 people blocking the doors to the building. Inside, councillors voted to set aside $500,000 from lottery reserves in case the Township ends up in court over the issue.

While the Township has identified itself as an unwilling host for a wind farm, the Feed in Tariff (FIT) agreement for the Stoneboat Community Wind Farm project doesn’t need municipal approval. Mr. Ince acquired the FIT contract from the group behind the Whispering Winds wind farm…
